In order to promote the development of legal science, the representation of Kazakhstan legal science in the international scientific space, strengthening international scientific relations, ensuring a high level of quality of scientific publications in the journal "Law and State", its development as an international scientific journal, the present Editorial Policy and Publication Ethics of the journal "Law and State" has been approved, compliance with which is mandatory for all participants of the publication and editorial process.
By entering the publication and editorial process, participants pledge to be guided by the principles outlined below and to avoid unethical behavior.
Publisher and thematic focus of the journal
- The journal "Law and State" is published since 1997 by M. Narikbayev KAZGUU University. Frequency of publication – 4 issues per year.
- The work of the journal is organized and supported by an international editorial council, editorial board and editorial office of the journal.
- The journal is a legal scientific and scientific-information publication, where Kazakh and foreign authors publish the results of their scientific papers on the problems of general regularities of the state and law development, historical, comparative-legal and actual scientific-applied sectoral research to improve legal policy, legal regulation and public administration.
- In addition to scientific articles, the journal also publishes reviews of new scientific legal publications, review and informational articles on significant scientific conferences on the problems of state and law.
- Articles are published in Kazakh, Russian, English languages. In each article the author, title, abstract and keywords regardless of the language of publication are given in three languages - Kazakh, Russian, English.
- Articles in the journal are published free of charge, no fee is paid to the authors. An electronic copy of the published journal is sent to all authors.
- All articles of the journal are publicly available and can be downloaded free of charge by individuals, libraries, universities and scientific and other organizations.
Publication Ethics of Authors of Scientific Publications
- The material sent by the authors to the editorial office of the journal (hereinafter referred to as a scientific paper) should be distinguished by the originality and relevance of the information contained therein.
- The authors undertake to submit a scientific paper that has not been previously published, is not intended for publication in other publications and is not under consideration by them, about which a corresponding entry is made at the end of its text. Otherwise the authors should inform the editorial board of the journal about this.
- The following are submitted to the editorial office: an electronic version of the paper, a photo of the author (preferably an artistic, non–documentary portrait). The last page is also sent in a scanned version with the author's signature.
- The authors are responsible for the content of the scientific paper, the reliability and completeness of the data presented in it, including information about the co-authors.
- The authors are responsible for errors, inaccuracies of a scientific and factual nature, falsification and fabrication of data, copyright infringement, plagiarism.
- Plagiarism in any form and manifestation is unacceptable. In the case of using or quoting the results of scientific research by other persons the authors are obliged to provide a link to the relevant source and include it in the bibliography.
- The authors must ensure the proper design of the scientific paper, including footnotes and bibliography in accordance with the rules in force in the journal.
- If it is necessary to rework or finalize a scientific paper, the authors undertake to cooperate with the editorial board of the journal to make the necessary adjustments.
- Authors should not allow manipulation of citations, namely excessive and inappropriate citation of affiliated persons (supervisor, colleagues, etc.) and inappropriate self-citation in accordance with the topic of the paper.
- It is unacceptable for authors to turn to agency services for the preparation of papers for the publication of scientific research results (except for the use of translation services), falsification of the composition of the authors, - the inclusion of persons who are not the authors of the paper in the composition of the authors or the exclusion of real authors from the number of authors and the indication of fictitious authors.
- Undergraduates, masters, applicants, postgraduates and doctoral students, if the paper was not specially commissioned by them, submit to the editorial office together with the paper the review of the supervisor and after that the paper undergoes the established procedure of double "blind" review.
- Each author has the right to publish no more than 2 articles during the year and no more than one article per issue, including articles co-authored. This rule does not apply to the publication of reviews and reviews of scientific events.
- All papers published in the journal are assigned an international registration number (DOI), the indication of which is mandatory when quoting and bibliographic description of the paper.
Publication Ethics of the Editorial Board of the Journal
- The Editorial Board of the Journal "Law and the State" is its official representative in accordance with the current legislation as well as the Charter of Maqsut Narikbayev University.
- The Editorial Board of the Journal accepts for consideration previously unpublished scientific papers that are not intended for publication in other publications and are not under consideration by them, containing new relevant information in the field of state and law and the results of original scientific research.
- When accepting scientific papers, the Editorial Board of the Journal is guided by the principle of non-discrimination and performs an initial assessment of the received material solely from the point of view of its scientific significance, value, quality and design of the paper, compliance with the scientific profile of the journal.
- In the process of reviewing a scientific paper the Editorial Board of the Journal undertakes not to use the results of scientific research contained in it for any purpose. Such use is allowed only after the official publication of a scientific paper with a proper reference to it.
- The Editorial Board of the Journal undertakes not to transfer the authors' material under review and/or peer review to third parties, except for those appointed by reviewers, and also not to transfer the authors' material to other journals.
- In case of rejection of a scientific paper by reviewers the Editorial Board, the Editorial Board reserves the right not to have a discussion with the author on the grounds of rejection.
- The Editorial Board of the Journal undertakes to ensure objectivity when considering a scientific paper through the procedure of double "blind" review and if necessary additional or repeated review (if there are significant comments and significant improvements).
- The Editorial Board of the Journal has the right to independently make technical and minor editorial changes to the text of the paper, including taking into account the opinions of reviewers and bringing the paper in line with accepted standards for the design of papers in the journal.
- When submitting a scientific paper for review the Editorial Board of the Journal should not allow contractual or pseudo-censorship as well as the reviewer providing a review of his own scientific paper.
- The Editorial Board of the Journal undertakes to maintain the confidentiality of editorial processes.
Publication Ethics of Reviewers
- The review of scientific papers submitted to the editorial board of the journal is carried out by members of the editorial board and if necessary by members of the editorial board and other reviewers, specialists in the profile of the topic of the paper.
- The journal adheres to the policy of double "blind" review, in which the identity of the author and the reviewer is not disclosed. The reviewers of the additional and repeated review are also not disclosed. A repeat reviewer may be a reviewer of the primary double-blind review.
- The review procedure assumes an objective and reasoned assessment of the scientific significance, novelty, value, validity of conclusions and quality of a scientific paper. Any other kind of assessment and criticism, in particular personal, is not allowed.
- Reviewers undertake to review scientific articles submitted to them in good faith and within the prescribed period (as a rule, no more than 14 days), checking them for borrowings. Reviewers are obliged to promptly inform the editorial board about the existence of valid reasons preventing the review from being carried out within the prescribed period.
- The repeated refusal of a member of the editorial board to review papers and violation of the review period implies the need to voluntarily resign from the editorial board and replace him with another member of the editorial board.
- Reviewers undertake to competently, concisely, clearly and clearly formulate in the review the essence of the recommendations that should be communicated by the editorial board to the author of the scientific paper if necessary its revision or revision.
- In the process of reviewing a scientific paper reviewers undertake not to use the results of scientific research contained in it for any purpose. Such use is allowed only after the official publication of a scientific paper with a proper reference to it.
- Reviewers undertake not to transfer the authors' material under review and/or peer review to third parties.
- Reviewers have the right to reject papers in case they reveal facts of plagiarism as well as papers that in their opinion do not meet the requirements of the journal in terms of content and design with the justification of their decision.
- Reviewers should not allow unethical behavior in the form of contractual or pseudo-censorship as well as providing a review of their own scientific paper.
- Work on the editorial board, reviewing articles in the journal "Law and the State" and publishing papers in this journal are taken into account when certifying the teaching staff of Maqsut Narikbayev University.
